General Terms and Conditions of Rotho Kunststoff AG

1. validity

Our deliveries are made exclusively on the basis of these General Terms and Conditions (GTC). These GTC apply to the processing of all orders placed with Rotho Kunststoff AG via the Internet. These GTC shall be deemed accepted by the Customer at the latest upon receipt of our goods.
Our online product offers are only valid as long as they are visible on the website and as long as stocks last. The images shown on the website are for illustration purposes only and are not binding.

2. conclusion of the contract

Our internet offer is not an offer in the legal sense, but an invitation to make an offer. With the final confirmation of your order, you make us a binding offer to conclude a purchase contract. Thereafter, you will immediately receive an e-mail from us about the receipt of your order. The acceptance of your order and thus the conclusion of the contract is made by delivery of an order confirmation with the track & trace number of your package, if the shipment has taken place. In the case of prepayment, we confirm the conclusion of the contract by sending our account details.
All offers are subject to change. We are free not to accept an order for any reason and to refuse its confirmation. We reserve the right to change prices and product ranges at any time. Deliveries will only be made if the delivery and billing address is in Switzerland. There is no minimum order value.
If after the order confirmation it is determined that the delivery cannot be completely fulfilled because individual products are not in stock at short notice, we will inform the customer in writing of a new delivery date.

3. prices and shipping costs

All prices include the statutory sales tax or value added tax. We ship all purchased items free of shipping costs.

4. delivery time

All deliveries are made within 3-5 working days. If we do not have an item in stock, we will immediately inform you of a new delivery date.

5. payment conditions

Payment is made at our discretion by prepayment, Paypal, Twint invoice, credit card, Postfinance Postcard or e-finance. The invoice amount will be debited after delivery of the order confirmation with the track & trace number. We reserve the right to deliver goods only against prepayment. In case of payment on account, you undertake to settle the invoice amount within 14 days after receipt of the goods. If you are in default of payment, we reserve the right to charge a reminder fee. You may only exercise a right of retention if the claims arise from the same contractual relationship.
Payment by sending cash or checksis not possible. We exclude liability in case of loss.

Purchase on account with installment facility (POWERPAY)

MF Group / POWERPAY offers the payment method "purchase on account" as an external payment service provider. With the single invoice you can easily pay your online purchase by invoice. If you decide not to pay within the specified time frame, you will receive a monthly invoice with an order summary in the following month.

When the purchase contract is concluded, POWERPAY takes over the invoice claim that has arisen and handles the corresponding payment modalities. When purchasing on account, you accept in addition to our terms and conditions, the AGB of POWERPAY. (powerpay.ch/en/agb).

6. retention of title

The delivered goods remain our property until full payment. The customer is obligated to cooperate in measures that are necessary to protect our property. In particular, upon conclusion of the contract, the customer authorizes us, at the customer's expense, to enter or note the reservation of title in public registers, books or the like in accordance with the relevant national regulations and to fulfill all formalities in this regard.

7. right of return and return instruction

If you are a consumer, i.e. a natural person who concludes the purchase for a purpose that cannot be attributed to your commercial or independent professional activity, you are entitled to the right of return described below. Excluded from this are goods that have been specially made for you according to individual customer specifications.

Return policy

You can return the received goods without giving reasons within 14 days by returning the goods. The period begins after receipt of this instruction in writing (eg as a letter, fax, e-mail), but not before receipt of the goods by the consignee (in the case of recurring deliveries of similar goods not before receipt of the first partial delivery) and also does not fulfill our legal information and other obligations. Only in the case of goods that cannot be sent by parcel post (e.g. bulky goods) can you also declare the return by requesting the return in text form. To meet the deadline, it is sufficient to send the goods or the return request in time. In any case, the return is at our expense and risk. The request for return must be sent to:

Return sequences

In the event of an effective return, the services received by both parties shall be returned and any benefits derived shall be surrendered. In the event of deterioration of the item and for benefits (e.g. advantages of use) which cannot be returned or which can only be returned in part or in a deteriorated condition, you must compensate us to this extent. You only have to pay compensation for the deterioration of the item and for benefits derived if the benefits or the deterioration is due to handling of the item that goes beyond the inspection of the properties and the mode of operation. By "testing the properties and functionality" we mean testing and trying out the respective goods, such as is possible and customary in a retail store. Obligations to refund payments must be fulfilled within thirty days. The period begins for you with the dispatch of the goods or the request for return, for us with the receipt.

8. warranty and right of exchange

The statutory warranty provisions apply. In case of defects in the delivery, please contact our customer service by e-mail (rothoshop@rotho.ch) immediately after noticing them. The customer service will send you a return label within two to three days. You can return the defective goods to us free of shipping costs. We will replace defective goods. Should this be impossible or unreasonable in individual cases, we will refund the purchase price already charged.

In case of an incorrect delivery, please also contact our customer service by e-mail (rothoshop@rotho.ch) as soon as you notice it. The customer service will send you a return label within two to three days. You can return the wrongly delivered goods to us free of shipping costs. The purchase price will be credited again upon receipt of the goods.

9 Jurisdiction, Applicable Law, Severability Clause

If you are a merchant, a commercial company or a legal entity under private or public law or a special fund under public law, the place of jurisdiction for all disputes arising from or in connection with the contractual relationship is the registered office of Rotho Kunststoff AG, although we are also entitled to take legal action against you at your place of residence or registered office or any other place of jurisdiction granted by law. In the case of disputes arising from consumer contracts, you may bring an action at the domicile or registered office of one of the parties.
All legal relations between us and the customer shall be governed by Swiss substantive law, excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention, CISG). If you are a consumer, those statutory provisions of the state in which you have your habitual residence shall also apply, which may not be deviated from by agreement.
Should individual provisions of these GTC be invalid, this shall not affect the validity of the remaining clauses.
